General Terms and Conditions for the Sale of Gift Vouchers

1. Introductory Provisions

1.1. These General Terms and Conditions govern the rights and obligations between SMILLE DENTAL CLINIC s.r.o., registered address: Štefánikova 203/23, 150 00 Prague 5, Company reg. no.: 28434218, e-mail: info@smille.cz, tel.: 257 941 296 (the seller), and the buyer when purchasing electronic gift vouchers through the seller's website.

1.2. These Terms and Conditions apply exclusively to the purchase and redemption of gift vouchers offered by the seller. They do not apply to the actual provision of healthcare services, which are governed by the relevant legislation, healthcare records, the patient's informed consent and the internal rules of the healthcare provider.

1.3. The buyer may be a consumer or a business entity. A consumer is a natural person who enters into a contract with the seller outside the scope of their business activities or independent professional activities.

1.4. By submitting an order, the buyer confirms that they have read and agree to these Terms and Conditions.

3. Gift Vouchers

3.1. The seller offers electronic gift vouchers for selected services provided at SMILLE DENTAL CLINIC.

3.2. The seller offers in particular the following types of gift vouchers:
a) a gift voucher for dental hygiene,
b) a gift voucher for teeth whitening.

3.3. Each gift voucher is issued for a fixed amount corresponding to the specific service stated on the voucher.

3.4. The gift voucher is issued in electronic form and bears a unique code.

3.5. The gift voucher is not issued in the name of a specific individual. The person entitled to redeem the voucher is the person who presents a valid unique voucher code upon redemption.

3.6. The gift voucher is not a payment card, electronic money or any other payment instrument. It serves exclusively for the redemption of the service stated on the voucher under the conditions set out in these Terms and Conditions.

4. Ordering a Gift Voucher

4.1. The buyer orders a gift voucher through the seller's website.

4.2. In the order, the buyer selects the type of gift voucher, fills in the required contact details and makes payment by online card payment.

4.3. The buyer is required to provide accurate, complete and correct details in the order, in particular a correct e-mail address for the delivery of the gift voucher.

4.4. The contract for the purchase of a gift voucher is concluded at the moment the seller confirms the order. The gift voucher is issued and sent only after successful payment.

4.5. The seller reserves the right to refuse or cancel an order in the event of a technical error, an obvious pricing error, unavailability of the service or any other circumstance that objectively prevents the issuance or redemption of the gift voucher.

5. Price and Payment Terms

5.1. The price of the gift voucher is stated on the seller's website for the respective type of voucher.

5.2. Prices are stated in Czech crowns (CZK).

5.3. Payment for a gift voucher may only be made by online card payment via the payment gateway available on the seller's website.

5.4. The gift voucher is issued only after successful payment of the full price.

5.5. If payment is unsuccessful, the gift voucher will not be issued.

5.6. A tax document will be issued in accordance with applicable legislation.

6. Issuance and Delivery of the Gift Voucher

6.1. After successful payment, the gift voucher is sent in electronic form to the e-mail address provided by the buyer in the order.

6.2. The buyer is responsible for the accuracy of the e-mail address provided. The seller is not liable for non-delivery of the gift voucher caused by an incorrect e-mail address, a non-functional mailbox, spam filter settings or other circumstances on the buyer's side.

6.3. If the buyer does not receive the gift voucher, they must contact the seller at info@smille.cz. The seller will, after verifying the payment and order, resend the voucher or provide the buyer with the necessary assistance.

7. Validity of the Gift Voucher

7.1. The gift voucher is valid for 12 months from the date of issuance.

7.2. The date of issuance and/or the expiry date is stated on the gift voucher or is recorded by the seller under the unique voucher code.

7.3. After the validity period has expired, the gift voucher may no longer be redeemed.

7.4. Upon expiry of the validity period, the right to redeem the service stated on the gift voucher lapses and neither the buyer nor the voucher holder is entitled to a refund of the voucher price, an extension of its validity, issuance of a replacement voucher or any other alternative remedy.

7.5. The validity of the gift voucher is not extended.

8. Redemption of the Gift Voucher

8.1. The gift voucher may only be redeemed with the seller, i.e. at SMILLE DENTAL CLINIC.

8.2. The gift voucher may only be redeemed for the service stated on the voucher.

8.3. A gift voucher for dental hygiene may only be redeemed for dental hygiene.

8.4. A gift voucher for teeth whitening may only be redeemed for teeth whitening.

8.5. The gift voucher may not be exchanged for another service without the seller's consent.

8.6. Redemption of the gift voucher is only possible with a prior appointment booking. Bookings may be made in the manner set out on the seller's website, by telephone or by e-mail.

8.7. The gift voucher does not entitle the holder to receive the service at a specific time. The time of service provision depends on the seller's current availability.

8.8. The voucher holder must notify the seller that they intend to pay for the service using a gift voucher no later than before the service commences, and must present a valid unique voucher code.

8.9. The gift voucher may not be applied retrospectively to a service that has already been paid for by another means.

8.10. Upon redemption of the gift voucher, the voucher is deemed to be used up and may not be used again.

9. Single Use

9.1. The gift voucher may only be used once.

9.2. The gift voucher may not be partially used, split across multiple visits or applied incrementally.

9.3. If the voucher holder does not use the service in full for any reason, they are not entitled to a refund of part of the voucher price, substitute use or any other compensation.

9.4. The gift voucher may not be exchanged for cash, either in whole or in part.

10. Transferability and Protection of the Unique Code

10.1. The gift voucher is transferable.

10.2. The seller is not required to verify whether the person presenting a valid unique voucher code is the same person as the buyer.

10.3. The person entitled to redeem the gift voucher is deemed to be the person who presents a valid unique code.

10.4. The buyer and the voucher holder are required to protect the unique code against loss, theft, disclosure or misuse.

10.5. The seller is not liable for damage caused by loss, theft, unauthorised transfer or misuse of the unique code, unless such circumstances were caused by the seller's own fault.

10.6. In the event of reasonable suspicion of misuse, forgery or unauthorised use of the gift voucher, the seller is entitled to refuse redemption or temporarily suspend it pending verification of the voucher's authenticity and authorised use.

11. Restrictions on Use

11.1. The gift voucher may not be exchanged for cash or transferred to funds in a bank account.

11.2. The gift voucher may not be used after its validity period has expired.

11.3. The gift voucher may not be used for a service other than the one stated on it, unless the seller and the voucher holder expressly agree otherwise.

11.4. The gift voucher may not be combined with other discounts, promotions or benefits unless the seller determines otherwise.

11.5. The seller is entitled to refuse redemption of the gift voucher if:
a) the voucher is invalid,
b) its validity period has expired,
c) the voucher has already been redeemed,
d) the unique code is illegible, incomplete or does not match the seller's records,
e) there is reasonable suspicion of forgery, unauthorised use or misuse of the voucher.

12. Healthcare Service Specifics

12.1. The seller is a healthcare provider. Provision of the service stated on the gift voucher is always subject to it being possible, appropriate and professionally justified in view of the client's state of health.

12.2. The gift voucher does not create an unconditional entitlement to a specific healthcare or related procedure without prior professional assessment.

12.3. For the teeth whitening service, its provision may be subject to a prior examination, consultation or other professional assessment. If the seller concludes that teeth whitening is not appropriate in view of the client's state of health, the seller is entitled to withhold the service.

12.4. If it is not possible to provide the service stated on the gift voucher for health reasons on the client's part, the seller may agree individually with the client on an alternative arrangement, in particular the application of the voucher's value towards another suitable service. However, there is no automatic legal entitlement to such a change unless the parties agree otherwise.

12.5. Before a healthcare service is provided, the client may be required to provide the seller with the necessary cooperation, in particular to disclose relevant information about their state of health and to give informed consent where required by law or the provider's internal rules.

13. Consumer's Right of Withdrawal

13.1. If the buyer is a consumer, they have the right to withdraw from a contract concluded by distance means within 14 days.

13.2. The withdrawal period is 14 days from the date of conclusion of the contract.

13.3. The consumer may withdraw from the contract by any unequivocal statement addressed to the seller, in particular by e-mail sent to info@smille.cz.

13.4. The consumer may use the model withdrawal form attached to these Terms and Conditions. Use of the form is not mandatory.

13.5. It is sufficient for the consumer to send the withdrawal before the 14-day period expires.

13.6. The consumer may not withdraw from the contract if the gift voucher has already been redeemed and the service has thus been provided or used.

13.7. In the event of withdrawal from the contract, the seller will invalidate the gift voucher.

13.8. In the event of a valid withdrawal, the seller will refund the payment received without undue delay, no later than 14 days from the date on which the withdrawal was delivered to the seller.

13.9. The payment will be refunded in the same manner in which it was received, unless the seller and the consumer agree otherwise.

13.10. After the 14-day period has expired, the buyer is not entitled to a refund of the voucher price, unless otherwise provided by these Terms and Conditions or applicable legislation.

14. Order Cancellation

14.1. An unpaid order may be cancelled without any charge.

14.2. After payment, the consumer may proceed in accordance with the withdrawal rules set out in Article 13 of these Terms and Conditions.

14.3. After the withdrawal period has expired, the order may not be cancelled and the buyer is not entitled to a refund of the voucher price, unless otherwise provided by these Terms and Conditions or applicable legislation.

15. Complaints

15.1. The buyer is entitled to raise complaints in particular regarding defects relating to the issuance, delivery or functionality of the gift voucher.

15.2. A complaint for the purposes of these Terms and Conditions means in particular a situation where:
a) the gift voucher was not delivered after successful payment,
b) the gift voucher contains incorrect details,
c) the unique code is not functional,
d) an incorrect type of voucher was issued,
e) a duplicate or erroneous voucher was issued,
f) another technical or administrative error occurred on the seller's part.

15.3. Complaints may be submitted by e-mail to info@smille.cz or in writing to the seller's registered address.

15.4. A complaint should contain at least:
a) identification of the buyer,
b) the order number, if assigned,
c) the unique voucher code, if delivered,
d) a description of the complained-of defect,
e) the buyer's contact details.

15.5. The seller will handle complaints without undue delay, no later than 30 days from the date they are raised, unless the seller and the consumer agree on a longer period.

15.6. In the event of a justified complaint, the seller will in particular correct incorrect details, resend the gift voucher, issue a replacement gift voucher or take other appropriate remedial action.

15.7. Complaints under these Terms and Conditions do not cover dissatisfaction with the course or outcome of the healthcare service itself. Such matters are handled in accordance with the rules for the provision of healthcare services and the seller's internal procedures.

16. Personal Data

16.1. The seller processes the buyer's personal data primarily for the purpose of processing the order, issuing and delivering the gift voucher, maintaining voucher records, complying with legal obligations and protecting the seller's legal claims.

16.2. Personal data is processed in particular in the scope of name and surname, e-mail address, telephone number, billing details, order data, payment data and data on the redemption of the gift voucher.

16.3. Detailed information on the processing of personal data is set out in the separate document "Personal Data Processing Policy", which is available on the seller's website.

17. Out-of-Court Dispute Resolution

17.1. In the event of a consumer dispute between the seller and the consumer, the consumer has the right to turn to an entity for out-of-court resolution of consumer disputes.

18. Final Provisions

18.1. These Terms and Conditions are governed by the law of the Czech Republic.

18.2. If any provision of these Terms and Conditions is invalid or ineffective, this shall not affect the validity and effectiveness of the remaining provisions.

18.3. The seller is entitled to amend these Terms and Conditions. The version of the Terms and Conditions in effect at the time the contract is concluded shall always apply to the buyer.

18.4. These Terms and Conditions take effect on 1 June 2026.
